I have a question. Our files are stuck in the Chicago local office (after our interview last year) and the only thing pending is the Namecheck, which has been pending for more than 180 days. Our PD is current. Is anyone in the same position?
It is frustrating because you do not get any LUDs when your files are in the local office and I have no indication whether the Chicago officeis processing cases with NC pending > 180 days. Anyone knows?

Hi ,
I have a PERM filed on Nov 2006. and it is approved. Like most ppl here I also applied for I-140 & I-485 during July and got the receipts. I am looking to change companies using AC21 by next Jan but would like to keep my H1B active.
I have the following qns:
a. If I find a new employer(B) who is willing to transfer my H1B, will I get extension 3 yr extension beyond 6 yrs based on my current employer(A)'s PERM and approved I-140.
b. I know that 3 yrs extension is possible with approved I-140. Is it possible with new employer also (the one who has nt filed ur GC ? Also Is 3 yr extn possible after filing I-485 beyond 6 yrs?

I ran into similar circumstances in 2008 and i accepted some amount on 1099. So far nothing has happened. At that time money was more important for me than anything else. It was just one instance in my 5 years on H1. Right now i applied for I-140 and waiting for approval. I maintained my H1 status pretty good all the time. If there is ever an enquiry i'm thinking of explaining the proper reason why i accepted the payment on 1099. Hopefully there shouldn't be any problem.
To sum it up, It is illegal to accept payments on 1099 when you are on H1. And i would advice everyone to stay away from 1099. Every case is different and you never know what is going to happen

As long as previous employer not revoked/Cancel your i-140 you are safe. You can port your priority date.
But i don't see any body who ported PD even if prior employer cancel or revoke.

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

I am going to file application for renewal of EAD of my spouse.She was on H-4 when she came to USA and she got EAD last year. She will start working from Aug 08. She has not used her EAD till now but went to India on AP.
1.What is manner of last entry and the current immigration status for her? Is it Parolee or H4 status in both cases?
2.I have filed I-485 after July 2007. Can I E-file? As I read somewhere on forum that On or after July 30, 2007, applications may not be electronically filed and must be submitted to a Service Center via regular mail or courier service.

I too had the paralegal filled out wrong information in regard to my employment history. My lawyer said the same thing; once it is on ETA 9089, you could not really change anything.
In fact, you could not change it when you file I-140. The only thing you could do is to discuss with your lawyer about possible RFEs.
Last but not least, don't sweat it. Worrying won't change anything.
And as for my case, it was approved without any RFE request.

hi all !!
my husband concurently file I-140 and I-485 (along with EAD and AP) on 22nd June 2007. We got our I-140 approved on 30th August. I have two questions
1. When can i expect my EAD ?
2. Is there any rule that i shud start working within some stipulated time after getting my EAD or i can take my own time ?
I wonder I am waiting for my I-140 approval since DEC'2006 and your got approved within few weeks...my goodness

I am kind of worried with all these.
I presently work for company A whose first 3 years of visa will expire in oct end.
In july sometime I requested company B to file a transfer and they did and it got approved .the date starts from july.However i told company B that i need more time t join them and they agreed to it.
While i was talking to compay A attorney for extension i mentioned to him that i ahve another H1b approved from company B. To which he said ," if that H1b is filed as concurrents then its not a problem. But if its filed as "change in emplyer" then you should have been working for that emplyer from the start of its approval." However company A attorney agreed to jsut file extnesion wihtout mentioning the another approval.
I then asked the i-129 petion frm company B and found that its filed as "change in emplyoer". I asked him about the problmes i might face in extnesion with compnay A visa to which he said.."Don't worry..you don't need to mention about second approval while extneding with company A. You won't have problem gettign extension". it need to be filed as "change in emplyer not concurent.Is this true....???

I received an RFE for my Birth Certificate as the Originals were not available as it was submitted to the school during admissions and when i spoke to them they said that we cannot issue you the original certificate. So i went to my native and requested the Municipal to issue me a BC and they agreed and issued me a copy with all the details but the certificate was dated March 2009 as the issuing date which was not accepted by the USCIS and they sent me a RFE for my birth certificate.
I have read the posts on this forum but none of them relates to my issue. I have a duplicate copy issued by the Municipal Authority which contains the seal and signature of the authorized gazetted officer. This is the same certificate which was submitted to the embassy and based on which i received my K1 Visa. What should i do? Please this is very very urgent as i have to submit the RFE by end of this month. Can i just submit a letter with 2 affidavit's from my family explaining to them that in India you don't receive birt certificate back from school or the graduation certificates do not contain your parents name and place of birth.
