Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. It is all because most people want free lunches. This needs to stop. The 200 people going to DC tomorrow are going to speak for you and me for yours and mine greencard. They are taking time off and spending own money for you and me. Nothing is free in this world. IV is also doing this for you and me and we are taking it for granted. Yes the people who were able to get their companies open offices in the states where the approval times were faster were smarter than me! Because I believed in the system and they did not.

Hi everyone ,
i have three question please please anyone answer ....
1 - i have previously applied but was returned due to pd not current , what to file in the form where it say if u have appllied before ? ( i am filing on my own this time )
2 - should the salary be there on employment letter . if so the present day salary or the one with labour approve ?
3 - i have an A# when my file was returned should i use that or leave it blank wherever it is asked also my wife have TIN number is that what i am supposed to write where it ask her to give her SSN

The employment letter should state the salary and should also say the job is full time and permanent. Also include general job description and job title matching the labor cert.
You should include your A# wherever it is asked for. You do NOT put the taxpayer ID # instead of SS#, leave it blank.
Regarding your first question. I would suggest the truth is always the truth and check the yes box to an application being filed before and add a short explanatory note with it.

Based on your calculations , Experts, please let us know what to expect, if 12000 GC are released for EB2. Where will the cutoff come and stop..

12000 GCs for EB2 India and China means, with out any doubt it fetches 5 months forward movement.
But at present scenario EB2 China is at 22JUL06 and Eb2 India is at 08 May 2006.
On an average EB2 India has a demand of 1.5k per month.
EB2 China has a demand of 700 per month.
So the EB2 India moves 7 months ahead where as China moves 4 months ahead.
So both EB2 India and China will have the same Cut Off dates and it would/might be: May + 7 Months = December 2006 .

I checked some family based data and Date jumps 2-3 years once in a 2-3 year period and NVC gets enough files to work on for next 2-3 years , so dates moves slowly for next 2-3 years. USCIS learned lesson from July 2007 and may follow same approach what NVC do.
They might go upto 2008 or 2009 in advance this year or next year so they have almost 20-30 k Eb2 cases on hand which can last for year or two. USCIS needs some new cases to work on. All pre adjudicated cases are ready for approval so chances are there they can advance date so that they can get enough cases for next year's spill over quota.

My wife got the approval on Oct 5th...CPO mail was first followed by approval notice and I also got a CPO mail after 35 days of approval....strange and surreal it seems

I may be wrong since my wife's case was separated.....But this was from my congressman's office who told me that the reason that her case is pending and delayed is because our case got separated during adjudication.

(Even nitty gritty details like which day and time the Immigration Officers generally will be in a good mood to hear us - Yes its true that our situation without GC is that pathetic). It might be so helpful for others who are still waiting to deal effectively with these officers. During my conversation with one IO, she told me the IO's ID who is reviewing my kid's file and asked me to send a detailed mail to that IO.

I saw this link Murthy's email too. The total pre-adjudicated cases in the chart is matching with the total in the document. Well now there are more un-answered questions:
1. Does all other pending 485 include employment based ? If yes what % are employment based ? Obviously we do not have any country specific data on these.
2. Is there any way to know whether individual case is pre-adjudicated or not ?
USCIS has fooled us again. No good statistical analysis can be done on incomplete/inaccurate data. I am going from hopeful to hopeless again. I am EB2-I Feb 2006.

However as it was pointed out in another forum, Texas and Nebraska process only EB cases. In their cases, the rate of preadjudication is very high....over 90% in Texas. I cant fathom the Nebraska numbers.
The preadjudication numbers, in my opinion, are of the EB cases. The data, on the whole, needs to be explained by USCIS, better.

From 2004 I did not report the fraud since I did not know about it. Right now - I wont report it since I dont want to create disruption in this environment - disruption that can come back to bite me. A year down the line - when the environment and the economy is a little better - you bet I will report it now that I know about it.

I think you should be able to file the 485 yourself. The form is simple. If you can get a lawyer to do it and get all the appropriate 140 approval docs- the better, but I don't foresee any issues "doing-it-yourself".
Advace Parole is a travel document that lets you return back into the US without a H1B stamp on your passport. The AP has to be renewed every year along with the EAD (employment authorization doc) card.
Hope this answers your question. -- Now lets go back to sending faxes and calling senators.

Guys, we have already seen the Dec visa bulletin and there is absolutely no change in processing dates so its even more important to fix the AC21 issue ASAP. With this huge delay in 485 approval, more and more people will force to get into AC21 and will see more denials.
