Should the job title for PERM labor filing be in Job Zone 5 to qualify under EB2 category? Or could one apply in Job Zone 4 and still qualify for a EB2? Also, does having an MBA, exempt a person from EB quota under any of the proposed bills like STEM, SKIL, PACE, TALENT or should it have to be an MS in Engineering.
A quick response would be greatly appreciated.
Not sure about the first question. SKIL bill will exempt any advanced degree from US or Advanced degree in STEM from outside + 3 Years. PACE, TALENT and the current CIR only exempt STEM Advanced degree + 3 Yrs

No you do not need an airport transit visa if you are travelling via Germany by Lufthansa using ur AP. Until and unless you do not change terminals it should be fine and all lufthansa flight arrive/depart from same terminals.
I just returned yesterday using my AP and I traveled via Munich.
You will be asked for your AP at immigration in India as well as while transiting in Germany..

There was a report on Mathew Oh's site that
some people travelled in 2008 got a messed up I-94
forms( printing bug). So whoever travelled in 2008
may want to have a very good look at their I-94 and
correct it if needed.

Correct and valid I-94 should have 11 digits of I-94 numbers. If your I-94 shows only 9 didits or 10 digits or less than 11 digits, your I-94 card is one of these million's defective cards. The agency is recalling such defective I-94 cards for replacement I-94. Reportedly these defective I-94 cards were issued at the Calgary Airport in Canada and potentially other airports as well. Those who have such defective I-94 should contact Deferred Inspection posts or any Port of Entry for issuance of replacement I-94. Defective I-94 can create a number of problems down the road unless they obtain replacement I-94.

My father passed away recently and my mother wishes to travel with my wife and I on a visitor visa.
How can she apply for 10 year multiple entry visa? Can she return after the visa expires, after a month? Any experiences anyone can share? Are there any reasons why some visas get denied?
My wife and I are permanent residents and we want to know whether this is of any advantage/disadvantage.
Any pointers/info/help are much appreciated. I looked through the relevant IV threads and yes, they are informative but rules change all the time and I decided to just go ahead and post this thread to get the latest feedback.

In september my dates became current and my GC and my spouse GC has been approved . However my lawyer recieved interview notices for me and my wife. What should be the next step. Ignore the notices as we recieved the Green card or do we need to attend the interview.

We filed for adjustment of Status in August 2006 and received EAd's and travel documents. We have not yet received fingerprint dates. Will it take this long? Any advise on how to deal with this?

I applied for H1B cap exempt physician job on june 25th with my lawyer at vermont service center( wrong center by my lawyer's mistake) and my I-94 Expired on june 30. Vermont center lost or misplaced my file till july 22nd and when we send 2nd file with premium processing they found old file and forwarded it to california center and returned new file back to us. However california center placed recieved date as 22nd july. Later on the center asked for my medical license and that 22days out of status explanation. We send my license which was issued on august 23rd and explained about that 22days out of status. Finally they denied my petition just giving the reason that my license was issued later after my initial petition was filed meaning i was not eligilble for the job when i filed and cannot consider the evidence that came after in existence........now my question is
1-) in final decision they didnot mention anything regarding that 22days out of status issue
however mentioned that i filed on july 22nd.
so when now i go to consulate in india should i mention this 22days as out of status as overstay or still i am in status because i have my fedex reciept of sending my file on june 25th and final decision came on sept 15th. Need expert opinion guys ....thank you...

This is a simple and straightforward case.
Rules are: You are allowed to change the company but you should be in "same or similar" position.
Your new company will have to agree to continue to support the existing green card process i.e. they may have to give employment verification letter if and when asked by USCIS..
All in all I think you are in the safe..

No Not an option at all. I wish there was an option for USCIS/DOS to recapture wasted visa numbers. Same with the PBEC. The only thing that can provide relief to every one is legislative action. Please actively take part in the DC rally to get legislative relief.

For FP, USCIS takes the address from G325A or from the I485 form. The reason I am asking is because my company is putting their's address in I485. So I am wondering.
