My lawyer received all the receipts for our AOS, EAS and AP applications and today I got COPIES in mail from her.
Wasn't she supposed to send me the originals and keep the copies? After all, it's my application.
I want to call her but I'm not sure what the general practice is. Did you guys get copies or the original receipts from your lawyers?

I'm interested in purchasing a better Nikon Zoom lens for my D70s. I have the 18-70 DX lens (which is great), but I also have the basic 55-200mm zoom (which I am not happy with). I've been searching online for a 70-300 Nikon lens & I can't figure out which one to get. There's the 70-300mm f/4-5.6D ED AF Zoom-Nikkor & the 70-300mm f/4-5.6G AF Zoom-Nikkor. Which is the better model, the D series or the G series? I'd like to get the new 70-300 VR, but my pocket can't handle that right now.
Any help would be greatly appreciated.

I have my I-140 approved. My wife is filling I-539 form for extension of stay. I just want to make sure from you guys, in the form where it says 'Are you an applicant of an immigrant visa' she has to say 'No'. As I am guessing until I-485 is filed, our answer to this question is always 'No'.

I am travelling to India and I have got AP. I also have an I-94 when I arrived last time to US. This is expired and I also have a I-94 with my last H1b (expires in June 2010). Now, I am working on EAD.
My question is which I-94 I need to return to the Airlines while boarding the flight?
Also, I am starting my flight from Cincinnati to Washington. From Washington I have a connection to Dubai and then to Chennai. Where should I submit my I-94?

If she entered without inspection she will have to process her green card in her home country unless you can get a waiver. But if she came here legally and her I-94 expired you may be in luck. You will have to file I-130, and I-485 for her. You will also have to submit I-130 for her son who will apply for an immigrant visa in Nicaragua. You may want to talk to an immigration attorney who will be in a better position to direct you on this.
Also this forum is mainly targeted at employment-based immigration and you may not get answers here for a family-based immigration issue.

I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.
also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.
my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?
also which status we have to fill in. "Married filing jointly/separately".
please reply as soon as possible.

Does any one know how a company from a foreign country(India) can open a bank account in USA.
There is a possibility to register as a company in US and then apply for business account. But being still on H1 dont feel comfortable to register a company in US.
Are there any other ways a company in foreign country can open an account in USA to do the business at least to get the payments from the US customers.
Are there any suggestions to specific banks like wells fargo or so that would help in the process?
How about credit unions like DCU? Do they offer such provisions?
Any thoughts on this would be greatly appreciated..

Yes the bottom line is you have to withdraw one. In my case, I have to write in letter to USCIS in Nebraska becase I did self-filing. I've spoken to an agent a while ago. She said withdrawal will not affect my other I-485. Consult with your attorney. I already have a finger printing appointment next week so I'm goin to withdraw the I-485 receipt from Nebraska.

While setting up an appointment through VFS for H1B stamping in Mumbai, I am asked the following question:
Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?
Should I answer Yes or No? I guess the answer is Yes since I have a valid I797 H1 approval. But, I need expert opinions from you guys as well. Here is some background:
I have H1 visa stamp through my old employer "O" (with an expiry of March 2006). I changed employer "X" in Nov 2003. My H1B has also been renewed in Nov 2006 (with "X"). i.e. I have had two valid I797 H1 approval notice with "X" since Nov 2003 - one for change of employment through my current employer from Nov 2003 to Nov 2006 and then a renewal from Nov 2006 to Nov 2009 (this is currently valid). I have not been to India since July 2003.
Please advise what the answer to the questions above. Also, is this visa stamping considered a renewal since my old visa stamp is through my old employer?

I have two I -140's approved with one PD from end of 2005 and other end of 2006 both on EB2. I 485 is based based on 2nd one in 2006. So question is can I port 2005 pd to I 485 based on 2006?
Some where I heard that you can only port the PD when your 2nd is application stage and is pending. but here it is applied and already approved. Is it a good case for Porting PD or interfiling?
And by the way what is the difference between porting and interfiling?

you should be able to use your old PD ...Just ask your attorney to contact USCIS with your old I 140. and New I 140. Lot if times USCIS automatically links your PD's . But again its USCIS?? Our company is brought by another company and countdown has started for our group. Looking at present market conditions I may have to use EAD. Will try to transfer H1 but just in case ...

My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.
