IV seems to have a lot of folks here on a h1b with a non profit organization. My wife is currently doing her residency in a non profit organization on a h1b so basically she is not subject to the cap.
After she finishes, and she looks for jobs, is it possible to get a h1b transfer in a profit organization without being subject to cap? Or H1b transfer is possible only with an non profit organization.
Any inputs will be well appreciated.

If you get laid off, hopefully you have enough years on your initial 6 yr H1 to work with another employer an apply for a new labor and get back on track.

People who get labor approved in August, can they avail current window provided by USCIS and concurrently file 140/485?

Same thing happened with me - My labor was approved from Phily BEC on Mar 16th 07 and my company kept saying that didn't receive anything till Apr 16th 07...
Then i was impatient and called Phily BEC and they were very nice to explain me that it can take upto 1.5 months to 2 months for my company to receive via Lawyer. In fact it may take 1 month for Phily BEC to mail - he explained.
Eventually my company received the Labor papers on May 7th 07....

I will take this oppurtunity to thank everyone who showed the courage by joining us at Washington DC.
It was a great pleasure meeting all the people from the New England area. I finally got a chance to put a face to all the names with whom i have talked on conference calls. This was just an amazing experience and i am hoping we will get a chance to have more such experiences and we will keep on continuing our efforts till the time we get the system fixed.
Folks, the rally was a huge success. The situation room (15th, 16th, 17th) was an example of all the positive energy which was builing up for the rally.
The reception(17th) was a showcase of IV. The rally(18th) was the final bang.
But inspite of having so many people affected from the GREEN CARD delays from the New England area, we just had a few folks show up at the rally. This was really disappointing.
I am sure there must be a very good reason for that. But if you have any doubts, we will really like to talk to you and clarify your doubts.

I had my H1B from A Company,Recently i have moved to B Company where i was asked to go to UK for Business purpose.I have yet to have stamping from B Company.I still have valid visa till end of next year from Company A name stamping in the passport.Will there be any issues for comming back from UK without having stamping.

Secondly, you don't need a new stamp as your old stamp is still valid but, make sure you carry all the H1 paperwork from your new company.

My labor was filed with job title from the employer as IT Lead (O*Net Code - 11-3021.00, O*Net title - Computer and Information Systems Managers). I am having an opportunity to convert to full-time on EAD (I-140 approved, EAD received 18months back). The new job title is Software Engineer(possible O*Net codes - 15-1032.00/15-1021.00/15-1031.00, possible O*Net title - Computer Software Engineer/Computer Programmer). Is it possible to file AC21 in this scenario. The salary and the job descriptions for both the Labor filing and the new opportunity are similar. I am worried if the title might cause a problem. I have to make a decision very soon. Please help.
as far i have learnt from the discussions in forms "Title" should not be a problem.
But the O*Net Code should be the same.
Meaning new job should fall under the same job code.

According to this document, if you switch jobs it IS better to file the AC21 and inform the USCIS, just in case trhe employer decides to reovke the I-140.

You can use the valid visa from Co. A provided that you also show the H-1B approval from Co. B on returning to the US.

I am trying to find health insurance for my spouse who is in H4 visa.
Could you please let me know if I can buy the health insurance only for her? Is there some law which states H1B visa holder also needs to buy the health insurance along with the spouse?
BTW, I am living in NJ.
Appreciate, your inputs and pointers on this issue.

My wife is on H4 and she is studying Masters and we already have EAD. She would like to do Internship and she still has 6 months to graduation and my question is
1) Is there any time restrictions for people to do internship (with GC based EAD)
2) After graduation, can she still continue with her internship (using EAD ofcourse) ?
3) If Yes for question 2, then for how long after graduation she can be an intern
Apreciate if someone can give feedback on this.
