You must have I94 showing H1B classification and validity dates to change status to H1. You can travel and re-enter with a H1 visa stamp and obtain h1 status. Please check with the company attorney,

Do I need to send the copy of visa stamp even if my stamp has expired and I am working on EAD? (my I-797/I-94 expired too).
Can someone please answer this as I need to apply for ead renewal soon.

infact in intial eveidence
1) copy of passport or DL or Visa Page or some national Id with picture
2) color photos
3) copy of 485 recipt or EAD
She said most of the attornies/lawyers are asking for extra documentations so that to pre-empt RFEs but she asked me to file with intial evidence that is asked on the instruction form i.e the three items i mentioned above.
I filed with those if they require additional evidence i will comply.

Attorney is correct, when the requirement is Bachelor+5yr means Bachelors should be 4yr degree, Remember there is a big difference between Bachelors degree vs Bachelor degree equivalent;)

But my lawyer chose this. and I already signed the form. Does it really matter? As he stated " Spose has an approved I-140"
I'm sure you'll be okay. All they want to know is the basis of your eligibility for filing I-485 and choosing (h) and adding this explanation should be fine.

My Labor is stuck in Atlanta processing center.... It is frustrating to see people getting approvals in 2 days from Chicago center.
While people who apply to Chicago today, can file 485 by July, I'm gonna miss the boat :eek:

I am filing for I-485 for my wife based on my approved I-140 and pending I-485 (EB2). Under part 2 which option i should chose for her.

My suggestion. One of my very close friend who is also working for same employer as mine is exactly in same situation as yours.. only diff. she is on H1. Recd. her EAD, FP notice.. but no AP yet. She needs to fly on Nov 10. She got infopass appt. for requesting expedited AP. She was asked to bring along EAD and AOS receipt notices, her travel reservations and any document pertaining to travels.. her passport and Visa papers.. SO this way they could process or request AP on expedited basis. Hope this helps.

Hello,
I have been approved for a new H1 visa for 2 years - Consulate Case. My previous visa extension was denied & so applied for a new one with a different company in a different state. I m trying to book an appointment online for the interview in which I have to fill up DS 156 form. There is one question # 24, where it is asking me write the address where I will stay. At present, I have not decided on address as I don't know stamping would be approved or not. So what do I need to write there. I presently stay in a different stay where I own a house.
Lawyers & experienced people pls. help out as soon as possible... I am running out of time...

The address should be the one which you are currently staying (on file with USCIS when you filed for GC or notified using AR-11).

Mine got approved in about 2 months time. My labor certificate reached the lawyer who passed it on to my employer.
I did a big mistake of not asking for a copy and again when I received it while filing I140 - did not make a copy again.
Please save a copy for yourself - it helps a lot while switching jobs during AC21.

Also, if some one can point me to any state website link that clarifies this, that would be great. I tried to search http://www.spb.ca.gov/index.htm?e=1, but couldn't find anything specific regarding this.

at one point. Your school should have an office of international students or such who would have clear understanding of scenarios such as yours. In addition, an immigration attorney needs to be consulted.

My wife went to US consulate in Kuwait for her H4 stamping on Feb 18th. During the interview she was informed that some administrative process on their end was not completed and asked to pay for the DHL service and was told that she would be contacted by DHL who would collect her passport, get the visa stamped and return it to her. She was also told that it should not take more than 2 weeks.. On her application form, the interviewer wrote NO PIM.
Since then it has been a harrowing time for us. It has been 6 weeks, since then and we still have not heard anything. We have tried contacting the consulate using phone, email and at times my wife personally went to the consulate but she was not allowed to enter. We do not hear anything back from them.
I can understand a couple of weeks, but now its more than 6 weeks and counting. We have already cancelled her and my son's flight tickets once. We have rescheduled my son's doctor's appointment. This delay is having a domino effect on our lives.
My question is - Is there anything that we can do to expedite this process.

I' am a new member and I recently read about IV group on samachar.com with regards to the flower campaign. Congratulations to all of them who could file thier I-140's and I-485's. Special thanks to all those who were involved in getting this resolution.
This is my first post and I would like to know if we can all get together and request DOS for accomodating all the pending applicants with BEC's during the October's Visa bulletin.
I know it sounds ridiculous but if you put the numbers together...currently there are around 25000 applications pending with BEC's and by Aug 17th those numbers might come down to 22,000. I' am not sure what would USCIS or DOS would gain in holding these 22000 applications back. May be 50,000 with dependents.
The best solution would be to have PD's of April'2005 for all EB categories in the month of October'07. If IV group could lobby for all the remaining applicants at BEC's, then it would be ideal for every one. Justice to all aspiring legal immigrants.
All of us can then focus our energies on other issues like Visa numbers, capturing unused visas, not counting dependents in the visa quota etc.
I hope everyone (those who have already submitted I-140's and I-485's) can support us on this issue and this should be on top of all the priorities.
Please provide any suggestions you might have on this subject.
