Hello, I am on the same boat... kinda...
I submitted the application with supporting doc paper base on June 2 and they receieved and signed the package on June 7 to NSC
Til today check was not cashed. I called the service center and the lady told me to wait til July 8 to call them again and they will look in to it... and she said since it's summer time NSC is backing up.... and it does take up to 30 days to get anything.
(However, I have been reading... ppl efile seem have better luck to get any movement... some ppl got the EAD card within 20 days!!!!!)
I read some ppl also did paper and after a month... they go for the efile... but I still did not hear if that would creat any problems...
I don't mind to waste the 340 if it can make my EAD processed....
I would rather have the card in my hand then check my checking account everyday to see if the check was cashed....
anyone did both paper and efile after one another and got approved????

it is my understanding that she just needs your H1 approval notice, employment letter, your pay stubs etc. I don't think she even needs her H4 approval notice for her H4 stamping. I am very sure that only your H1 related documents are needed(she needs your original H1 approval)-please check with your lawyer

Hello Gurus,

also try taking appointment by sending someone to the mumbai office. only a portion of the appointments are available on the internet. you can get a better date by taking a local appointment. it can be taken anywhere where there is VFS office (pune etc) if mumbai is not a convenient place for you. this was the case around 3 years ago, i dont know if it has changed now, but worth exploring the option.

not sure about I-140, i think it should be ok to mention your spouse name but check with your immigration lawyer about this.
NOTE: as far as i know, if your wife is in H4 visa, you can file her AOS (I-485) as your spouse. But if she is in F1 visa, you CANNOT file her I-485 as your dependent along with your I-485 since she is in F1 student visa. but check with your immigration lawyer about this..

There was a report on Mathew Oh's site that
some people travelled in 2008 got a messed up I-94
forms( printing bug). So whoever travelled in 2008
may want to have a very good look at their I-94 and
correct it if needed.

Correct and valid I-94 should have 11 digits of I-94 numbers. If your I-94 shows only 9 didits or 10 digits or less than 11 digits, your I-94 card is one of these million's defective cards. The agency is recalling such defective I-94 cards for replacement I-94. Reportedly these defective I-94 cards were issued at the Calgary Airport in Canada and potentially other airports as well. Those who have such defective I-94 should contact Deferred Inspection posts or any Port of Entry for issuance of replacement I-94. Defective I-94 can create a number of problems down the road unless they obtain replacement I-94.

My H1B 6th year expires in December 07,
I applied for I140 using 2004 approved labor in July 1st week and applied for 485 this week.

But you may be able to apply for transfer and 3 year extension with the new employer after you get your I-140 approval. Pls check with your lawyer.

I am in a complicated situation...
Approved labor (PD 2003 EB2) from company A (not employed with them). Filed 140 and 485 (self as primary and wife as dependent). Ability to pay RFE on 140 and then denial on 140 and 485. Currently, appealed the decision because needed to get H1 extension and case has reopened. My wife (with company B) had her 140 approved (EB3 with PD 2006) and so after the July bulletin filed for 485 (her as primary and me as dependent) because my case seeemed a little dicy.
So we both have multiple 485's filed (although the first one since the decision is not final on 140 technically they might not have started considering the 485). Read multiple places that legally you can have only one 485 approved but could have multiple 485 pending and withdraw the other once anyone has been approved. Is this true? or you CANNOT even have two 485 pending?What is the best thing for me do do right now?

I had to withdraw my application since I had to file for a divorce. I was just told yesterday that my petition in withdrawn and my wife will be notified in a week. I was also told that I can re-file before.
Currently we have withdrawn the Divorce papers as well. But I don't know what steps to be taken for re-file.
She has an A number which I can provide now. But the two question I have is her current USCIS status? She came on K1 and another question is "Have you ever applied for Perm. Res.?" The Answer will be yes with date and place of filing, but what should I write for final disposition.
Please help this is urgent.

My I-140 was approved in EB2 with company B from TSC with PD:01/26/2004 and I-140 pending in EB2 with RFE in the present company A. I do not know at this point when it will be cleared. BTW receipt no# is with EAC. Does it mean it went to NSC for processing? It is high time for me to shift to company B on H1 transfer as per our understanding. Presently I am on 7th year extension and left with 2 months for 8th year ext.
Questions:
(1) Can I transfer to company B based on recent I-140 approval and get 3 year extension?
(2)If I have to get 3 year ext. I have to wait until I-140 is cleared from present company and then got for 3 year ext. then transfer to company B. But I guess it will be long wait and no one know what happens until the RFE is get okayed and I-140 will be approved. So my choice here is very limited in that aspect.
Crux of the problem is that I have better opportunities out side the present company and running short of time to make a firm decision to tell the present employer that I am looking out side which is very sensitive issue to handle on all other aspects.
I just received copy of I-140 approval notice from my attorney. So time is running out for me to make a decision in shifitng company from A to B.
