Hi,
My wife got her H1B in Oct 2008. But could not work until date.
We want to get her H1B transferred back to H4. There are NO pay stubs for her.
I am on H1B with job. And I have my pay stubs.
Will there be any problem in her H1B to H4 transfer without her pay stubs ?

Dont worry pokiri, just apply for trasnfer thru lawyer. My friend recently did it for his wife. She got H1 to H4 in 2 months without any RFEs. She did not work after she got her H1 in 2007 April and she don't have pay stubs.

so it looks like the only way out for a prospective indian investor would be to start his enterprise outside usa, get employed in it for 1+ yr, then enter the usa on L1 and apply for GC under EB-5 category?

I'm not from India but I believe in Karma. We create our own future through our actions. If we perform a good action today we can expect a good result. That is why it is so important that the undecided people attend the rally!
Think of retrogression as Sansara. A vicious circle. It is only by acting and creating our own Karma that we will get out of Maya and see reality. Our gren cards will not fall from the sky, we have to go get them! By not going to Washington and assuming that your green card will suddenly appear out of nowhere, you are proving to yourself that you are stuck in some sort of immigration avidya.
We need to act with selflessness as in Karma Yoga, so that we can understand how our unity will bring the results we seek, to all of us.
Remember Arjuna when he realizes before the battle that his enemies are his own family. We at IV should not be our own enemies by not attending the rally, because we all know what Krishna told Arjuna: "Your duty is to fight"
Instead of hurting each other, we need to use karma and our friendship for each other to unite in our common cause and fight. Remember, our duty is to fight, it is our choice then to fight against each other (by not attending the rally and letting others do it) or fight all together, united against retrogression, and create the good Karma that will ultimately defeat the broken immigration system.

You will be able to return to same employer if you get employed again with your old employer.
Alternatively, you can file new H1 with a new employer. YOu dont need to go visa stamping, but your son need to go in either case.
Make sure you either have a project with client letter or your employer has position to employ you on genuine internal project that can be documented well. Its not question of past pay stubs for you. Its about having valid and verifiable employment now.

If anyone is planning to drive from CT for the rally or is not driving because they are unsure, or not motivated enough... then here is your chance.
We can join together and go to DC and come back together. I am planning to go on Monday 17th morning. Ill be coming from New Haven/Hamden area in CT.
If anyone is planning to go in the evening, we have a BUS service available also. We are starting 6:30 PM from Woburn, MA on the 17th and should be reaching Hartford at around 8:15 - 8:30 PM, New Haven at about 9:00 - 9:15 PM.
Please also keep on checking http://immigrationvoice.org/forum/showthread.php?t=12628 thread for the latest updates on the bus starting from MA.
Also if you are on highways 84 and 91, let us know, as we can pick you up on the way.

some body told me that if you are on H1B1 then you can not file for greencard. is it true?

I enter US four times this year by using AP, same airport, but different experience. 1st, 2nd and 3rd entry was sent to secondary check. But the 4th entry, the CBP said it's unnecessary for secondary check and fill new I-94 because previous officers are new guys, don't know the rule. I thought 1st entry is definitely need go secondary check.

I also dint receive the FP notice for my son. When I checked the USCIS help desk and also with my attorney for my son's (5 years) FP, I was told that kids under 16 years (16 years if I correctly remember) dont need FP in 485 processing.

You could try to reopen the case with Supporting evidence of ill health and age. This is a long shot, but a good attroney should be able to pose a compelling argument. Also, try to get an infopass appointment and talk to someone about your options.

Hello friends,
I am on L1B and working in US for last 3 1/2 years. My L1 visa will expire in Jun 2011. In between another company is ready to sponsor H1B for me and it will file it in April 2010. So here are my questions.
1. From when i can start working with new company on H1 ? From Jun 2010 (after getting H1 approval) or will have to wait till Oct 2010 ?
2. What will be the duration of my new H1B visa, considering i already used 4 years of my L1 ? Is it 6 years or only 2 years ?

Hello folks. Here is the overiview.
485 EB3 world, applied Augut 8, 2007. ND is Oct 8, 2007.
I just checked today and saw LUDS on my cases. NO lUD on 485 at all. (not approved) No LUD on AP or EAD. (these are approved)
These are all approved as well.

I140 LUD 7/13/2008
I290BLUD 7/13/2008 (I had to file because my H1 extension was denied. It was approved after the appeal. However, the status for this still shows received and we will let you know when we make a decision. this was 2 years ago. I have since then able to extend my h1 again.
No LUDs on EAD OR AP cases. NO LUDS of any kind for my wifes cases as well.
What does all this means. The messages are still the old ones, nothing new. Just LUDS on these cases. Does that mean that my 485 is going to be denied or that they might be looking at my case in the near future. does this mean that they may be looking for more information. Has anyone of you had LUDS on any of your old cases but not on your 485 case. I have ready somewhere that some got LUDS on older cases.
How is USCIS wokring on Sunday. 7/13 was yesterday and it was Sunday.
