I am happy to read this. My observation is that Indian-American US citizens generally don't care about the Indians who are going through the process of immigration. In November 2005 when some one approached IAFPE with retorgression problem, their NC chapter conducted a seminar in Raleigh and some 100+ members did sign a petition. But they handed over petition to Bobby Jindal and it looks like from what is reported elsewhere on this site, he belongs to anti immigrant camp. But except this seminar even this organization did not take more interest in this issue. But I hope India Community Center has shown way and more Indian-American as well as Chinese associations would come forward to support the issue. Can some one approach Asia Society in DC who last week organised a speech by President Bush?

My I-140 is pending, and my H1B renewal is also pending. Can I travel to India? If yes, what will I show as proof at re-entry?
How will it be for my wife? She is on F1 going on to OPT and a pending I-485 linked to my I-140 application.

I suggest you do premium processing of H1 extension or wait until approval. As far as your wife is concerned, I am not clear if she has a visa stamp. If not she can enter on AP.

I lost my job in January and since I was not able to get a new project. So, returned back to India in May'09. My AP was valid till 21-July-2009. I did not file for extension while in US.
Now, I am getting a job in US and the employer is asking if I could join immdiately. Please let me know:
1. If there is any option for me to renew my AP from India?
2. Any other options, since my H1B got expired (6 years) in May'09.
Note: My EAD is valid till June 2010.

Do we get a notice to get biometrics done when you apply for EAD renewal?
My wife and I have a EAD renewal RD of June 23, 2008 at NSC. We have not gotten any LUD after that. Anybody knows how long it takes to get the EAD?

One of my family member came to US on visitor visa a year ago. She was granted 6 months visa at the port of entry. After 6 month, she filed for another B1/B2 extension with USCIS and was granted another 6 month of stay. The 6 month extension is about to expire.
She had booked her tickets and got ready to leave but unfortunately she became seriously ill and currently is not in a condition to travel. She is going through medical treatment but because of the seriousness of the illness, it might take another couple of months before she is healthy enough to travel.
Now the question is can she apply for 2nd extension of visa based on medical ground. By law, can she even file for a 2nd extension given that she has already been in the country for about 12 months. I talked to an attorney and he said that she can file but likelihood of getting another extension is very low.
If another B1/B2 extension is not possible, is there any other kind of visa available for her to stay here while she is going through the medical treatment?

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

1) Why TSC is late in issuing receipt compared to NSC?
2) Looks like more applicaiton were filed at NSC than at TSC, Why?
3) Why even then TSC is late in issuing reciept?
4) Which one is faster in approving 485, TSC or NSC?
5) Does any body know how many application each service center recieved during the VB fiasco?

It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic. Hi folks
We have applied for COS for my wife from H4 - F1, and yesterday we got approval.
(TOOK ONE MONTH APPROX),
Now the question is,
I AM AWARE THAT SHE HAS TO GET STAMPED IF SHE TRAVELS TO INDIA, BUT what if she travels to India, when on OPT status????
Any seniors had experienced the same situation?????????

8th Year H1 extension applied by current company. Still in process, should be approved in Nov 2006.
Can I transfer to a new company using this H1 ?
There is nothing tricky, it is plain and simple: you want to switch jobs?
You have to apply for a new H1. You absolutely cannot use your current H1 to work any other job.

Incase there was adelay in degree due to backlogs what information has to be entered in section 17 DS-157
enlisting of all educational institutions attended" section on DS 157 form, I completed my degree late due to backlogs .i.e. I was supposed to complete it in 1996-2000 but I completed it in 2005 due to backlogs and since I had started a job already during my studies.
Now i am confused weather I shall put 1996-2006 or 1996-2000 on dates of attendance of my university in DS 157?
Please help !
